Article 1 – Definitions
In these terms, the following definitions apply:
Article 2 – Applicability
1. These terms apply to every offer made by Grace Luxury Wax and to every agreement formed with the customer, whether it concerns a product, a treatment, or both.
2. Deviations from these terms are only valid if agreed in writing, and apply only to the specific agreement in question.
3. Where the customer acts as a business (e.g. a salon purchasing for resale), separate or additional terms may apply, to be confirmed in writing in advance.
Article 3 – Offers and formation of the agreement
1. All offers by Grace Luxury Wax are without obligation unless explicitly stated otherwise.
2. An agreement is formed once the customer places an order via the webshop and receives email confirmation from Grace Luxury Wax, or, in the case of a Treatment, once an appointment has been definitively scheduled.
3. Obvious errors or mistakes in an offer (such as a clear pricing error) do not bind Grace Luxury Wax.
Article 4 – Prices
1. All prices are listed in euros and include VAT, unless stated otherwise (e.g. for business orders).
2. Shipping costs are not included in the product price and are shown separately before the order is completed.
Article 5 – Delivery and shipping costs
1. Grace Luxury Wax ships to the Netherlands, Belgium, Luxembourg, Germany, France, Finland, Sweden, and Denmark.
2. Orders are shipped via PostNL or DPD.
3. For deliveries within the Netherlands: shipping is free for orders of €150 or more. Below that threshold, and for all other countries listed above, shipping costs are calculated based on weight and displayed before checkout is completed.
4. Stated delivery times are indicative and do not constitute a strict deadline unless explicitly agreed in writing.
5. Risk of damage or loss during shipping remains with Grace Luxury Wax until delivery to the customer, unless the customer has specifically chosen a carrier not offered by Grace Luxury Wax.
Article 6 – Right of withdrawal (returns)
1. Consumers have the right to cancel a product purchase within 14 days without giving any reason. This period begins the day after the consumer receives the product.
2. To exercise this right, the customer must notify Grace Luxury Wax within this period via info@graceluxurywax.com, and return the product as soon as possible, and in any case within 14 days.
3. Hygiene products with broken seals after delivery are excluded from the right of withdrawal, including but not limited to opened or used wax and used wax warmers. These cannot be returned for hygiene reasons, unless the product was already damaged or defective on arrival.
4. The right of withdrawal does not apply to Treatments that have already been carried out.
Article 7 – Return shipping costs
1. The cost of returning a product is borne by the customer, unless the product does not match what was ordered, arrived damaged, or the issue is otherwise attributable to Grace Luxury Wax — in which case Grace Luxury Wax covers the return shipping cost.
2. Refunds are issued within 14 days of Grace Luxury Wax receiving the return, or of the customer providing proof of return shipment, whichever is earlier.
Article 8 – Payment
1. Payment can be made via iDEAL, credit card.
2. Business customers may be subject to different payment terms, to be agreed in writing in advance.
3. In the event of late payment, the customer is in default without further notice, and Grace Luxury Wax is entitled to charge statutory interest and reasonable collection costs.
Article 9 – Warranty
1. Products with electrical components are covered by the manufacturer's warranty where applicable. Where no manufacturer's warranty applies, Grace Luxury Wax warrants the product to be free from material and manufacturing defects for a period of 1 year after delivery.
2. The warranty does not cover normal wear and tear, misuse, or repairs carried out by parties not authorized by Grace Luxury Wax.
3. This warranty article does not apply to consumable items such as wax and skincare products.
Article 10 – Treatments and appointments
1. Appointments for treatments can be cancelled or rescheduled free of charge up to 24 hours in advance. In case of a late cancellation, Grace Luxury Wax reserves the right to charge 50% of the total treatment price.
2. Grace Luxury Wax reserves the right to refuse or reschedule an appointment in case of contraindications for the treatment.
Article 11 – Liability
1. Grace Luxury Wax is not liable for damage resulting from improper use of products by the customer, or from failure to follow pre- or aftercare instructions for Treatments.
2. To the extent permitted by law, Grace Luxury Wax's liability is limited to the amount of the relevant order or treatment.
3. Grace Luxury Wax is never liable for indirect damages, including consequential loss and loss of profit.
Article 12 – Complaints
Complaints regarding products or treatments must be reported in writing as soon as possible, and in any case within 1 month of discovery, via info@graceluxurywax.com.
Article 13 – Governing law and disputes
1. Dutch law applies to all agreements between Grace Luxury Wax and the customer.
2. Disputes between Grace Luxury Wax and a business customer will be submitted exclusively to the competent court of Rechtbank Noord-Nederland, location Leeuwarden, without prejudice to Grace Luxury Wax's right to summon the customer before another competent court.
3. Consumers retain the right to bring a dispute before the court of their own place of residence.
